Terms of service

These terms govern your use of Chivent Cards, operated by Chelodo B.V., a private limited company registered in the Netherlands (KVK 94820996). By placing an order, you agree to these terms. If you don’t agree, please don’t use the service.

1. The service

Chivent Cards lets you create a digital greeting card from a photo of your choosing. Our AI illustrates the photo in a picked style, lays it onto a template you select, and gives you a private share link to send to the recipient. The service is digital-only — no print fulfilment in this version.

2. No account, anonymous use

You don’t need an account. We use a single anonymous cookie to let you return to an in-progress draft from the same browser. Drafts you don’t complete are deleted after 24 hours. Paid cards are tied to the Stripe checkout session, and you can return to them via the success page link Stripe directs you to.

3. Photos and content you upload

You retain ownership of the photos you upload and the text you type into a card. By using the service, you grant Chelodo B.V. a non-exclusive, royalty-free, worldwide licence to process those inputs for the sole purpose of generating, storing, and delivering your card.

You warrant that:

  • you own the photos you upload, or have permission from everyone in them and from the rights holder to use them for this purpose;
  • if a photo includes a minor (anyone under 18), you are that minor’s parent or legal guardian, or you have written permission from a parent or legal guardian before uploading;
  • the photos and the text you write do not violate anyone else’s rights (including privacy, publicity, or copyright);
  • your card is not unlawful, defamatory, harassing, threatening, sexually explicit, hateful, or otherwise abusive.

We reserve the right to remove any card and to decline service to anyone who breaches this section, without notice.

4. AI-generated artwork

The card’s illustration is produced by a third-party AI model. AI output is probabilistic — the same photo can yield slightly different results between runs, and rare outputs may contain artefacts despite our best efforts. You can preview any number of styles before paying and only pay for a card you’ve chosen to send.

Subject to your rights in your input photo and text, the generated artwork in your final card is yours to use for personal, non-commercial purposes — for example, sending it, saving it as a keepsake, or sharing the link. Use of the generated artwork is also subject to the upstream model provider’s acceptable-use rules.

5. Acceptable use

You agree not to:

  • upload photos you don’t have permission to use;
  • create cards that harass, threaten, defame, or sexualise others;
  • use the service for spam, mass distribution, or unsolicited commercial messaging;
  • attempt to bypass rate limits, abuse the AI generation, or otherwise damage the service for others;
  • scrape, copy, or reverse-engineer the templates, illustrations, or interfaces.

6. Pricing and payment

The price of each card is shown before you check out. Payment is processed by Stripe. We never see or store your card details — Stripe is the merchant of record and the payment data controller.

7. Your right of withdrawal (EU/EEA consumers)

If you are a consumer in the EU or EEA, you have a 14-day right of withdrawal for the purchase of digital content under Directive 2011/83/EU on consumer rights. You can withdraw within 14 days of purchase, for any reason, by emailing cards@chivent.com with your Stripe receipt id. We will refund the purchase within 14 days of receiving your request, using the same payment method.

We do notask you to waive this right at checkout. As long as the period hasn’t lapsed, the right applies even if the card has already been delivered.

8. Other refunds

Outside the 14-day right of withdrawal, refunds are limited to cases where delivery fails on our end — for example, the AI generation fails irrecoverably, the share link doesn’t work, or our service is down at the time of purchase. Successful deliveries you change your mind about are not refundable outside the withdrawal period above. You can delete a card at any time from the success page (the page Stripe returned you to after payment).

For any refund request, email cards@chivent.com with your Stripe receipt id and we will respond within a few business days.

9. Service availability

We aim for high uptime but make no guarantees. The service is provided “as is”. If a fault on our side blocks delivery of a purchased card, we will refund the purchase. We may suspend or modify the service for maintenance, security, or capacity reasons.

10. Liability

To the maximum extent permitted by applicable law, Chelodo B.V.’s aggregate liability for any claim relating to your use of Chivent Cards is limited to the amount you paid for the relevant card. Nothing in these terms limits liability for death, personal injury, fraud, or any other liability that cannot be limited under Dutch law. Your mandatory consumer rights are not affected.

12. Changes to these terms

We may update these terms as the service evolves. Material changes will be reflected in the “Last updated” date at the top of this page. Continued use after a change constitutes acceptance of the updated terms.

13. Governing law and jurisdiction

These terms and any non-contractual obligations arising out of or in connection with them are governed by the laws of the Netherlands. Disputes will be brought before the competent court in the Netherlands, except where mandatory consumer-protection rules in your country of residence grant you the right to bring proceedings before another court.
